The NBA legend Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.
Team Investment and a Will to Win
Jordan shared financial and corporate details of his 23XI team, revealing he put in $40 million of his own funds into the Cup Series operation co-founded with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with separately owned franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for an hour and left the court to a media frenzy, with fans and media clamoring for a glimpse or a picture of the global icon.
Spearheading the Fight
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who testified before Jordan, are events from September 2024. She recounted a frantic and emotional period where the racing circuit told teams they had to sign a contract extension. The document spanned 112 pages outlining team compensation and a guaranteed entry in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that 112-page package and litigate the matter. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.
The Bottom Line: Victory
Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Success.
“Hamlin persuaded me adding a third car improved our chances to win,” he said, sharing that he purchased another franchise last year for $28 million amid the legal dispute. “So I dove in.”

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.
She said, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
