A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling allegations, he was held in immigration detention.

In her order, the court pointed out that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
